Getting arrested, whether it’s with or without a warrant (probably cause), could be a stressful and volatile time. Regardless, it’s a rule of thumb to keep calm when it happens and be as polite as possible to the officers. Once you’re arrested, you’d want to avoid doing anything that could make things worse or say things that could be used against you.

If you’ve watched any movies or shows that involve the police, you’d see that smarter characters would stay silent and then call their lawyer or criminal defense law firm to provide the expert legal advice on what to do or say. So, if you’re ever arrested in Kent, here are things that criminal lawyers and law enforcement agree that you should never do:

NEVER Resist Arrest

This is the first thing you have to remember: never, under whatever circumstance and whether or not you’re guilty, fight or resist the officer detaining you. Not only does resisting arrest lead to a physical response where you’d get hurt or injured, but the entire altercation could also be used against you as well. This also includes lying or claiming that you can’t be arrested because you need medical attention. Never antagonize or pick a fight with the cop or anyone else that’s arrested with you (assuming in this case that you’re arrested with someone else after, say, a brawl).

NEVER Say Anything You Don’t Have To

Upon arrest, you should never try and convince the police officer of your innocence or talk your way out of it, wait until your lawyer arrives so you can be properly advised on what to do and say.  One of the most famous lines you’ve probably heard of in detective or action films is the first parts of the Miranda Rights, particularly about your right to remain silent, and that anything you’d say could be used against you. So, while it is essential to be polite and cooperate with the officers, it’s best to only stick to the necessary information such as your name and wait for your lawyer before answering further.

NEVER Cave In Before Your Lawyer Arrives

Never believe what the police or detectives tell you to make you talk, as the law permits them to lie to get admissions; so even if you’re innocent, some details you might say could implicate you. If law enforcement is pushing you to answer questions and provide details, don’t cave in or panic; be polite and say that you’d want an attorney present first before proceeding.

NEVER Call work from the precinct’s phone

If getting arrested means that you’d have to miss work, make sure that you call a friend or family, or even your lawyer, to arrange a three-way call so that it wouldn’t be the jail phone showing up from your boss or manager’s caller ID.

Although getting arrested could be a nerve-wracking experience, you need to keep cool and remember the things that you should never be doing. Keeping these in mind could spell the difference between jail time and freedom.
